Terms of Service
The rules that govern your use of CDO HOMES — your responsibilities as a user, how we handle your personal information, and the limits of our role as a listing platform.
Last updated · October 3, 2026
Welcome to CDO HOMES. These Terms of Service govern your access to and use of the CDO HOMES website, mobile experience, agent dashboards, and messaging tools (together, the “Platform”). By creating an account, publishing a listing, sending an inquiry, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. About CDO HOMES
CDO HOMES is an online property listing and inquiry platform that connects buyers, renters, sellers, developers, and licensed real estate practitioners in Cagayan de Oro City, Misamis Oriental, and nearby cities.
CDO HOMES is a venue for listings and communication. Unless expressly stated otherwise, we are not a party to any transaction between a buyer and a seller or agent, we do not own the properties listed, and we do not collect payments for property sales or rentals. Any agreement for the sale, lease, or assumption of a property is strictly between the parties involved.
2. Eligibility and Accounts
You must be at least eighteen (18) years old and legally capable of entering into binding contracts to use the Platform.
- You agree to provide accurate, current, and complete information when registering, and to keep that information up to date.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You must notify us immediately if you suspect unauthorized use of your account.
- We may refuse registration, suspend, or close any account that we reasonably believe is fraudulent, misleading, or in breach of these Terms.
3. User Responsibilities
You are solely responsible for the content you post and the communications you send through the Platform. When using CDO HOMES, you agree to:
- Post only properties that genuinely exist and that you are authorized to advertise.
- Keep pricing, availability, specifications, photos, and location details accurate and free from exaggeration or concealment of material facts.
- Remove or mark as unavailable any listing that has been sold, rented, withdrawn, or otherwise taken off the market.
- Use the messaging and inquiry tools respectfully and only for legitimate property-related purposes.
- Comply with all applicable national and local laws, including the Anti-Fraud and Other Offenses law, consumer protection rules, and applicable real estate regulations.
- Not use the Platform to harass, threaten, discriminate against, or mislead other users.
- Not scrape, harvest, or resell listing data, contact details, or user information obtained through the Platform.
4. Agent and Broker Responsibilities
Users who publish listings in a professional capacity represent and warrant that they hold the licenses and accreditations required by law to engage in real estate service in the Philippines.
Under the Real Estate Service Act (Republic Act No. 9646), real estate service is reserved for duly licensed professionals. Agents and brokers are responsible for displaying accurate PRC and, where applicable, DHSUD registration details, and for ensuring that all marketing materials they publish through the Platform comply with the Code of Ethics and Responsibilities for Real Estate Service Practitioners.
CDO HOMES may request proof of license or authority at any time and may remove listings or suspend accounts that cannot demonstrate it.
5. Listing Rules and Prohibited Content
To keep the Platform trustworthy, the following are not permitted:
- False, duplicated, bait, or placeholder listings, including “test” listings published to the live site.
- Properties that do not exist, or listings for which you have no authority to advertise.
- Content that infringes copyright, trademark, or other intellectual property rights, including photos taken from other listings without permission.
- Discriminatory content that excludes buyers or renters on the basis of race, religion, ethnicity, sex, or disability.
- Content that is obscene, defamatory, or that promotes illegal activity.
- Solicitations for advance payments, “reservation fees,” or deposits made outside a lawful, verifiable transaction.
- Spam, chain messages, or unsolicited commercial content sent through the inquiry and messaging tools.
- Any attempt to interfere with the security, availability, or integrity of the Platform.
6. Inquiries, Messaging, and Contact Sharing
When you send an inquiry about a property, you agree to provide a working mobile number and email address so that the listing agent can respond. Agents receive the contact details you submit in order to follow up on your inquiry.
For your protection, the full contact number of a listing agent is only revealed after you submit an inquiry. Contact details shared through the Platform may be used only to respond to the specific property interest you expressed, and must not be added to unrelated marketing lists or resold.
7. Privacy and Data Protection
We collect and process personal information in accordance with the Data Privacy Act of 2012 (Republic Act No. 10173) and its implementing rules.
- What we collect: your name, email address, mobile number, account type, profile details you choose to provide, listings you publish, inquiries and messages you send, saved properties, and basic technical information such as device and usage data.
- Why we collect it: to operate your account, publish and display listings, deliver inquiries and messages between buyers and agents, verify accounts by one-time passcode, prevent fraud and abuse, provide support, and improve the Platform.
- Who we share it with: the agent or buyer you are corresponding with, and service providers who help us operate the Platform under confidentiality obligations. We do not sell your personal information.
- How long we keep it: for as long as your account is active and for a reasonable period afterward to meet legal, accounting, and dispute-resolution requirements.
- Your rights: under the Data Privacy Act you have the right to be informed, to object, to access, to rectify, to erase or block, to damages, and to data portability. You may exercise these rights by contacting us using the details in Section 15.
- Cookies and similar technologies: we use them to keep you signed in and to understand how the Platform is used. You may control cookies through your browser settings.
8. Intellectual Property
The CDO HOMES name, logo, design, and the underlying software of the Platform are owned by us or our licensors and may not be copied or used without permission.
You retain ownership of the photos, descriptions, and other content you upload. By posting content, you grant CDO HOMES a non-exclusive, royalty-free, worldwide licence to host, display, reproduce, and promote that content in connection with operating and marketing the Platform. You confirm that you have the right to grant this licence for everything you upload.
10. Disclaimers and Limitation of Liability
The Platform is provided on an “as is” and “as available” basis. While we work to keep listings accurate and the service reliable, we do not verify every listing, and we make no warranty as to the accuracy, completeness, legality, or quality of any listing, property, user, or transaction.
You are responsible for conducting your own due diligence before entering into any property transaction, including verifying ownership titles, encumbrances, permits, and the identity and authority of the other party.
To the fullest extent permitted by law, CDO HOMES shall not be liable for indirect, incidental, special, or consequential damages, or for any loss of profits, data, or opportunity arising from your use of the Platform. Nothing in these Terms excludes liability that cannot lawfully be excluded.
11. Third-Party Links and Social Sharing
The Platform may contain links to third-party websites, developer inventories, or social media services. We do not control and are not responsible for the content, policies, or practices of those third parties. Sharing a listing to a social network is subject to that network's own terms.
12. Suspension and Termination
We may suspend, hide, or remove any listing, and may suspend or terminate any account, with or without notice, where we reasonably believe these Terms have been breached, where required by law, or where necessary to protect other users or the Platform.
You may stop using the Platform and request deletion of your account at any time. Provisions that by their nature should survive termination — including intellectual property, disclaimers, and limitation of liability — will continue to apply.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, technology, or legal requirements. The revised version will be posted on this page with a new “last updated” date. Continued use of the Platform after a revision takes effect constitutes acceptance of the updated Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of the Philippines. Any dispute arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the proper courts of Cagayan de Oro City, Misamis Oriental.
Before commencing formal proceedings, both parties agree to attempt to resolve the dispute in good faith by contacting each other through the channels in Section 15.
15. Contact Us
Questions about these Terms, your account, or your personal information may be sent to the contact details published on our Contact page. We will respond within a reasonable period.
